سياسة الاتفاق الإلكتروني والموافقة
Electronic Agreement & Consent Policy
1. Digital Acceptance
The Platform treats certain defined electronic actions as forms of contractual acceptance, consent to data processing, or evidentiary confirmation, to the extent recognized as valid under applicable law. This Section distinguishes those actions from one another rather than treating "acceptance," "consent," and "signature" as interchangeable.
1.1 Acceptance Mechanisms
For the Terms and Conditions, the Privacy Policy, and any other document this policy or the referenced document identifies as requiring explicit acceptance, the Platform relies on an affirmative click-wrap action (e.g., clicking "I Agree" or "Accept" after being shown, or given a clear link to, the relevant document) rather than on continued use alone (browse-wrap). Continued use of the Platform after reasonable notice of non-material updates may be treated as acceptance of those specific updates, subject to Section 6.
1.2 Electronic Acknowledgment
Creating an account, submitting a proposal, accepting an offer, or otherwise using a Platform feature that displays or links to the applicable policy at the point of that action is treated as acknowledgment and acceptance of that policy, where the User was given a reasonable opportunity to review it before proceeding.
1.3 Consent Recording
Where the Platform records consent-related data (such as timestamps, IP addresses, device identifiers, or the method of acceptance), that data is retained to support an internal audit trail of platform interactions. This record supports, but does not by itself conclusively establish, the legal validity of any given consent or acceptance in an external proceeding; that determination depends on the applicable law and the specific facts.
1.4 Authorized Use of Accounts
Glancers treats actions performed through a User account as instructed by that account holder, subject to Glancers' account security and identity-verification procedures described in the Identity Verification (KYC) Policy. Users are responsible for safeguarding their account credentials. Glancers does not adjudicate internal disputes over account access or authority between a User and third parties acting on that User's behalf.
2. Electronic Signatures and Contractual Acceptance
2.1 Legal Validity
Where applicable law permits it, actions such as typed names, digital confirmations, or system-generated approvals may constitute a valid electronic signature or valid contractual acceptance. Glancers does not represent that every such action carries the same legal weight as a handwritten signature in every circumstance or jurisdiction; the legal effect of a given electronic action depends on the applicable law, the nature of the document involved, and the facts of the specific transaction. Certain categories of documents or transactions may, under applicable law, require a different form of signature or execution; nothing in this Section overrides such requirements.
2.2 Official Communications
For purposes of Glancers' internal Platform Dispute Review, in-platform messages, system notifications, invoices, and system logs are treated as the primary internal record of communication, with email communications treated as secondary supporting material. This internal evidentiary hierarchy does not, by itself, determine the weight any record is given in an external court, arbitration, or regulatory proceeding.
2.3 Document Integrity
Once an agreement is electronically accepted through the Platform, Glancers does not permit unilateral alteration of the accepted record through the Platform interface. Where technically implemented, agreements may be protected by integrity-preservation mechanisms (such as hashing) designed to make undisclosed modification detectable. The specific technical mechanisms in use are an implementation matter and are not warranted to meet any particular technical or legal evidentiary standard beyond what is stated here.
3. Binding Nature of Agreements
3.1 Enforceability
Agreements executed through the Platform are intended to be enforceable to the extent permitted under the laws of the Arab Republic of Egypt and any other applicable law. Whether a specific agreement is in fact enforceable, and against whom, depends on the applicable law and the facts of that agreement; this Section is not a representation that every agreement is enforceable in every circumstance.
3.2 Financial Commitments
User actions that trigger a payment obligation (such as approving a proposal, confirming a milestone, or placing a Gig order) are treated as an instruction that authorizes Glancers, and the payment service providers Glancers works with, to process the corresponding payment in accordance with the Payment & Billing Policy. Such actions do not, by themselves, establish that Glancers holds Client or Freelancer funds in trust, escrow, or custody; the nature of any such arrangement is addressed in the Payment & Billing Policy and the Freelancer Payout Policy.
3.3 Evidentiary Value
Platform logs, communications, timestamps, and transaction data are retained and may be used by Glancers as evidence in its internal Platform Dispute Review and, where relevant and admissible, in external legal proceedings. This Section does not represent that such records are conclusive or unchallengeable evidence in any external proceeding.
4. Consent Withdrawal
Users may withdraw consent for specific data processing activities under the conditions described below. This Section addresses withdrawal of consent to data processing; it does not address termination of the underlying commercial agreement between a User and Glancers, which is governed by the applicable Terms and Conditions and, where relevant, the Account Suspension & Termination Policy.
4.1 Withdrawal Process
Users may withdraw consent for specific data processing activities through available account settings, where offered, or through a formal request submitted via the channels described in the Privacy Policy.
4.2 Effect on Existing Agreements
Withdrawal of consent for a specific data processing activity does not, by itself, affect the validity or enforceability of agreements, obligations, or transactions established prior to the withdrawal.
4.3 Effect of Withdrawal Where Processing Continues on a Different Legal Basis
Where consent is the lawful basis for a specific data processing activity, a User may withdraw that consent at any time as described in Section 4.1. Withdrawal does not affect the lawfulness of processing that already occurred before the withdrawal, and processing that depends solely on that consent will stop once the withdrawal takes effect.
This is distinct from cases where Glancers has an independent lawful basis, separate from the User's consent, to continue processing the same or related data — for example, to comply with a legal obligation, to perform or exercise rights under a contract with the User where applicable, to establish, exercise, or defend legal claims, or to meet fraud-prevention or security obligations. In those cases, Glancers does not continue processing merely because it prefers to; it continues only to the extent, and for as long as, that independent lawful basis actually applies, and will state the applicable basis on request. Section 4.2 above addresses the related but separate question of a User's outstanding financial obligations, which are not extinguished by withdrawing consent to data processing or by closing an account.
5. Record Retention and Auditability
The Platform maintains electronic records to support accountability and compliance.
5.1 Record Preservation
Agreements, consent records, and related actions are retained for audit, compliance, and dispute-resolution purposes, in accordance with the retention practices described in the Data Processing & Protection Policy.
5.2 Audit Trails
Where implemented, the Platform maintains audit logs capturing user actions, approvals, and system events related to agreements, for the purposes described in Section 5.1.
5.3 Evidentiary Weight of Records
Electronic records maintained by the Platform are treated by Glancers as reliable evidence of the actions they record for purposes of Glancers' internal Platform Dispute Review, absent a credible showing to the contrary. This Section does not ask a User to waive any right they may have under applicable law to dispute the accuracy of a record in an external proceeding, and nothing in this policy limits any right that cannot lawfully be waived under applicable consumer-protection or other mandatory law.
6. Updates to This Policy
The Platform may update this policy to reflect legal, technical, or operational changes. Material changes to this policy will be presented for renewed acceptance in accordance with Section 1.1 before they apply to a User's continued use of features that depend on them; non-material changes may take effect on the notice terms described in the Terms and Conditions.
7. Contact Information
Users may contact the Platform through official channels for inquiries related to electronic agreements and consent.
